1. Acceptance of Terms
By accessing or using any services provided by Fyatu, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not access or use the Website, Mobile Application, or any Services. All Services are provided on an “as-is” basis without any warranty whatsoever.
These Terms constitute the principal agreement between you and Fyatu. For matters not covered herein, Fyatu may regulate such matters through Internal Policies published on the Website. Acceptance of these Terms means consent to both these Terms and all Internal Policies.
2. Fyatu Entities
Fyatu operates through the following registered entities:
- FYATU FINANCIAL TECHNOLOGIES LIMITED TZ — Tanzania, Company No. 173235208, TIN No. 173-235-208
- FYATU SARL — DR Congo, ID NAT: 22-K6500-N04125K, RCCM: BKV/RCCM/22-B-00022
- FYATU FINANCIAL TECHNOLOGIES — Ivory Coast, RCCM: CI-ABJ-03-2022-B17-00089
References to “Fyatu,” “we,” “us,” or “our” mean the applicable entity providing the Service based on your jurisdiction.
3. Services
Fyatu provides the following through its platform:
- Virtual Cards — Visa and Mastercard cards for online transactions, subscriptions, and contactless payments (Apple Pay, Google Pay), issued through licensed BIN Sponsor partners
- Money Transfers — Transfers to Mobile Money wallets (Airtel Money, M-Pesa, MTN, Orange Money) and eWallets (Binance, Skrill, Payoneer, Revolut, PayPal, Volet, Wise)
- Mobile Recharge — Airtime and data top-up for 180+ countries
- eSIMs — Digital SIM cards for 180+ countries and 7+ regions
- Card Issuing API — API for businesses to issue Visa/Mastercard cards under their brand
- Collections & Payouts API — API for businesses to collect payments and send payouts
- Wallet — USD-denominated wallet funded via Stablecoins (USDT, USDC), Mobile Money, and eWallets
Fyatu reserves the right to modify, add, or discontinue any Service with reasonable notice.
4. Eligibility
To use our Services, you must be at least 18 years of age and acting in full legal capacity. Business Accounts require the entity to be duly registered under applicable laws.
Fyatu’s Services are accessible globally, subject to applicable laws. By using Fyatu, you represent that you are legally permitted to do so, that your use does not violate any applicable laws, and that you are not subject to sanctions or restricted lists (UN, EU, OFAC, or other authorities).
Fyatu reserves the right to limit, suspend, or terminate access in any jurisdiction for legal, regulatory, or compliance reasons.
5. Registration and Verification
To open an Account, you must complete Registration by providing accurate information and accepting these Terms.
Individuals must provide: full name, email, password, and mobile number. Legal entities must additionally provide: company name, country of incorporation, registered address, director details, and business description.
To access the full range of Services (Verified Account), you must complete identity Verification by providing a government-issued ID with photo, mobile number, and any additional information required by our AML Policy. Legal entities must also provide incorporation documents, certificate of good standing, authorized signatory documents, and Beneficial Owner details.
Verification is typically completed within 24 hours but may take longer for enhanced due diligence. Incomplete or inaccurate submissions will result in Unverified Account limitations. You must notify us promptly of any changes to your Verification data.
6. Account and Wallet
Upon Registration, your Account is created with a USD-denominated Wallet. Funds can be held indefinitely with no interest charged or accrued. Transaction and balance limits apply based on your verification status and are published on the Website.
You are responsible for keeping your login credentials confidential. All actions performed with valid credentials are deemed your actions. Three failed login attempts will lock your Account — contact support to recover access.
Fyatu may lock your Account without prior notice for security reasons, suspected fraud, or violations of these Terms. The Account will be unlocked once the grounds for lockdown no longer exist.
You may close your Account at any time via Customer support, provided all obligations are fulfilled. Remaining Funds will be transferred to your designated payment details, minus applicable Fees. Multiple Personal Accounts are prohibited.
7. Transactions and Funding
You can fund your Wallet via Stablecoins (USDT, USDC), Mobile Money (Airtel Money, M-Pesa, MTN, Orange Money, and others), or eWallets (Binance, Skrill, Payoneer, Revolut, PayPal, Volet, Wise). Available methods vary by location and are listed on the Website.
Transactions are executed within 24 hours of receiving your Payment Order. Delays caused by third-party services are outside Fyatu’s responsibility.
All Transactions are final and irreversible, except for top-ups via external systems identified as fraudulent. You can download Transaction reports from your Account at no cost.
8. Virtual Cards
Virtual Cards are issued through licensed BIN Sponsor partners and are subject to Visa/Mastercard network rules. You may create multiple cards, subject to limits and Fees.
You are responsible for all card transactions and must maintain sufficient Wallet Funds. Card details (number, expiry, CVV) are confidential — do not share them. Fyatu may suspend any card for security reasons, Account Lockdown, or as required by the BIN Sponsor.
Chargebacks initiated by merchants or card networks may result in deductions from your Wallet.
9. Fees
Fees for Services are detailed on the Pricing page of the Website. Fyatu may adjust Fees with notice posted on the Website.
Fees are in USD, rounded to the nearest cent, and deducted directly from your Wallet upon Transaction completion. If your Wallet balance is insufficient, the Transaction may be declined.
10. Your Responsibilities
You agree to:
- Provide accurate, current, and complete information
- Keep your credentials confidential and prevent unauthorized access
- Notify us immediately of unauthorized Transactions or security breaches
- Maintain a non-negative Wallet balance
- Use secure, up-to-date devices and software
- Not use the Services for illegal purposes, tax evasion, or Prohibited Activities (see Section 12)
- Accept responsibility for canceled, invalid, or disputed Transactions and Chargebacks
- Comply with the laws of your country of residence
11. Prohibited Activities
The following are strictly prohibited, with a full list in the Appendix:
- Money laundering or terrorist financing
- Sanctions evasion, fraud, or identity theft
- Purchase or sale of illegal goods (drugs, weapons, counterfeit items)
- Gambling or betting (unless specifically authorized)
- Distribution of malicious software or hacking tools
- Circumventing System limits or security measures
- Impersonating Fyatu or its representatives
Violations may result in Account suspension, Fund freezing, reporting to authorities, and legal action.
12. Liability and Disclaimer
You are responsible for all Wallet activity, including Transactions by third parties with access to your credentials. You shall indemnify Fyatu against all claims, damages, and costs arising from your violation of these Terms or applicable laws.
Fyatu is not liable for:
- Losses from unauthorized access caused by your negligence
- Third-party payment service failures or delays
- System downtime for maintenance or causes beyond our control
- Your violation of applicable laws
- Indirect or consequential damages, including lost profits
Fyatu’s total liability is limited to Fees charged to you in the previous 3 months. All Services are provided “as is” without warranties.
13. Communication
We communicate via the email and phone number in your Account. You may contact us anytime via the support chat on the Website or at [email protected]. Communication is available in English and French.
We may send notifications about Service changes, new features, and offers. You may unsubscribe from marketing communications at any time.
14. Amendments and Termination
Amendments: Fyatu may update these Terms by publishing the revised text on the Website with at least 2 months’ notice. Continued use after the effective date constitutes acceptance. Fee changes may take effect with shorter notice.
Termination by you: Close your Account anytime via Customer support, provided all obligations are met.
Termination by Fyatu: We may terminate with 2 months’ written notice. After termination, remaining Funds are transferred to your designated details minus applicable Fees. Transaction records are retained for 5 years.
15. Governing Law and Disputes
These Terms are governed by the laws of the Fyatu entity providing the Service:
- Tanzania — for FYATU FINANCIAL TECHNOLOGIES LIMITED TZ
- DR Congo — for FYATU SARL
- Ivory Coast — for FYATU FINANCIAL TECHNOLOGIES
Disputes shall first be resolved through negotiation within 30 days. Unresolved disputes may be brought before the competent courts of the applicable jurisdiction. This does not affect your mandatory consumer rights under your local laws.

Appendix: Prohibited Goods and Services
The following are prohibited for sale, purchase, or facilitation via Fyatu:
- Weapons, ammunition, and defense products
- Drugs, controlled substances, and production materials
- Prescription medications and production instructions
- Falsified identification or government documents
- Law enforcement uniforms and restricted equipment
- Hacking devices, lock-picking tools, and malicious software
- Stolen personal data or spam-related services
- Goods or services violating intellectual property rights
- Child exploitation material
- Counterfeit or fake goods
- Explosive, toxic, or radioactive materials
- Human organs or remains
- Unlicensed financial or investment services
- Gambling, lotteries, and betting (unless authorized by Fyatu)
- Any services promoting violence, terrorism, discrimination, or hatred
- Advertising or promotion of any items listed above
